Which Makes the Neglect Provisions More Dangerous
The district built out principally between the 1890s and the 1930s. Under UDC Section 35-615 a violation is a civil offence pursuant to Texas Local Government Code Section 214.0015 and a class C misdemeanour, and the 5 year permit bar follows a hazard demolition preceded by 2 or more neglect notices. Texas charges no real estate transfer tax. UDC Section 35-455 requires materials to reach the historic preservation officer at least 15 days before a hearing, and Section 35-615 carries a 5 year bar on permit applications after a hazard demolition preceded by 2 or more neglect notices.
The thinner the margin, the greater the temptation to wait, and waiting is exactly what the code addresses.
An owner who cannot immediately fund a restoration and leaves a designated building open is on a path the code anticipates: deterioration, notices, and potentially a demolition as a public safety hazard that carries a five year bar on any permit application for the property. That is a worse outcome than any sale.
