About Designation

How Do I Know If My Property Is Designated?

The Office of Historic Preservation holds the landmark list and the district boundaries and will confirm it free. Contributing to a designated district is enough; the building need not be individually listed.

What Difference Does It Make After a Fire?

A substantial one. Section 35-615 of the Unified Development Code allows the preservation officer or the commission to petition code compliance to require correction of defects or repairs, so leaving a damaged designated building is not a neutral choice.

What Happens If I Ignore It?

A violation is a civil offence under Texas Local Government Code section 214.0015 and a class C misdemeanour under city ordinance, and enforcement can include injunctive relief joined with other code enforcement.

What Is the Five Year Bar?

Where a covered building has to be demolished as a public safety hazard, no application for a permit for a project on the property may be considered for five years, provided the owner had first received two or more notices of building neglect.

Can I Demolish a Designated Building?

Only through review. Section 35-455 governs applications for any landmark or property in a historic district, with materials due to the preservation officer at least fifteen days before the hearing.

The Fire Destroyed What Made It Significant. Is That Enough?

Section 35-614 allows the commission to recommend approval where significance has been irreversibly lost, but it must also find the changes were not caused directly or indirectly by the owner and were not due to negligent destruction or a lack of maintenance rising to demolition by neglect.

What If the Property Is Not Designated at All?

The preservation officer determines within thirty days of a completed application whether it may have historic, cultural, architectural or archaeological significance. Where it is found to have none, a demolition permit may be issued immediately subject to other code requirements.

Does the County Inspect Residential Construction?

It states that unless a residential permit was issued voluntarily, it lacks legal authority to regulate residential construction, conduct residential inspections, or issue a residential certificate of occupancy in unincorporated areas.

Can I Get an Inspection After the Work Is Done?

The county states it will not, on the ground that inspecting structural elements, wiring, heating and gas lines afterwards would require substantial damage to the finished building.

When Is a County Permit Required?

For new commercial, publicly accessible or multi-family construction, for a pre-built building placed on a property, or where an existing building undergoes a substantial improvement, under Chapter 233, Subchapter C of the Local Government Code.

Is a Fire Rebuild a Substantial Improvement?

It can be, and that determination belongs to Bexar County Public Works. Worth asking rather than assuming either way, because it decides whether permitting applies at all.

Why Does Everyone Ask About the Slab?

Because almost all housing here is slab-on-grade and heat damage to a slab is invisible. It is the largest unknown on most files in this county and what buyers discount most heavily for.

My House Is Brick. Does the Shell Survive?

Only if it is structural masonry. Post-war housing here is usually frame with a brick veneer that carries nothing, so once fire reaches the framing there is no shell to preserve.

Is Older or Newer Better After a Fire?

Older dimensional framing can sometimes be repaired in sections. Newer engineered trusses and floor systems exposed to heat come out whole, so newer construction more often becomes a rebuild.
